What Is Unfair Dismissal?

Unfair dismissal occurs when an employer terminates employment without a fair reason or fair procedures. The Unfair Dismissals Acts 1977-2015 protect employees in Ireland.

Who Can Claim?

To qualify: (1) be an employee (not self-employed); (2) have at least 12 months continuous service; (3) have been dismissed.

Time Limit

Bring your claim to the Workplace Relations Commission (WRC) within 6 months of dismissal (extendable to 12 months in exceptional circumstances).

Compensation

Maximum compensation: 2 years remuneration. Reinstatement or re-engagement may also be ordered.

How to Claim

File a complaint at workplacerelations.ie. An adjudication officer hears the case. Either party can appeal to the Labour Court.
