What Is Agricultural Relief?
Under Section 89 of the Capital Acquisitions Tax Consolidation Act 2003, a beneficiary who qualifies as a "farmer" can have the taxable value of qualifying agricultural property reduced by 90%. This dramatically reduces (and often eliminates) the CAT liability on farm inheritances in Cork.
Who Qualifies as a Farmer?
The beneficiary must pass the "farmer test" — 80% of their assets (after taking the inheritance) must be agricultural property. This is assessed immediately after the inheritance is taken. For most full-time Cork farmers, this is satisfied naturally.
What Assets Qualify for Agricultural Relief?
Qualifying agricultural property includes:

Active Farmer Requirement
There is an additional "active farmer" requirement to qualify for full relief. The beneficiary must either:
- Farm the land themselves for a period of 6 years after the inheritance, or
- Lease the land to an active farmer under a formal lease for a period of 6 years
If this condition is not met for 6 years after taking the inheritance, the relief is clawed back by Revenue.
